Our Policies
INCLUDABILITY COMMITTED EMPLOYER AGREEMENT
Between The Includability Collective LTD (trading as Includability) and [Committed Employer Name]
1. Parties
This Agreement is made between The Includability Collective LTD, a company registered in England and Wales, trading as Includability ("Includability"), and the subscribing organisation ("the Employer"), collectively referred to as "the Parties".
2. Scope of Services
As part of their Committed Employer status, Includability agrees to provide the Employer with the following:
- Completion of the six-pillar verification process (Diversity & Inclusion, Mental Health, Wellbeing, Talent Management, Sustainability, and Governance & Leadership)
- Access to the Includability Job Board, including role listings and candidate visibility
- Use of the Includability Committed Employer mark and associated promotional materials
- Participation in live support sessions, expert training events, and exclusive content access
- Ongoing community support and partner network engagement
- Enhanced visibility across Includability platforms and campaigns
- Any additional services or benefits made available during the subscription period
3. Contract Term
The Employer agrees to a minimum contract term of twelve (12) months from the date of signature (the “Initial Term”).
This agreement will automatically renew on an annual basis unless cancelled in accordance with Clause 6.
4. Fees and Payment Schedule
The total fee for the Initial Term will be confirmed at the point of contract, based on the Employer’s size, sector, and agreed level of service.
Payment can be made on one of the following schedules:
- Monthly
- Quarterly
- Every Six Months
- Annually
All payments must be made via Direct Debit or If agreed via Stripe to the bank account provided separately by Includability.
The Employer agrees to establish and maintain the Direct Debit/Payment arrangement throughout the contract period.
Invoices are available upon request and may be aligned to the selected payment schedule.
5. Payment Commitment
The Employer is contractually liable for the full 12-month fee, regardless of payment frequency.
If paying in instalments, all scheduled payments must be completed.
Early cancellation within the Initial Term does not release the Employer from its financial obligations.
6. Cooling-Off Period and Cancellation
6.1 Cooling-Off Period
The Employer may cancel this agreement within seven (7) calendar days of the signature date without penalty.
Written notice must be submitted and acknowledged by Includability. If services begin during this period, Includability reserves the right to charge a reasonable pro-rata fee.
6.2 Cancellation and Renewal Notice
After the Cooling-Off Period, the agreement is binding for the full Initial Term.
To avoid automatic renewal, the Employer must give no less than ninety (90) days' written notice prior to the annual recertification date.
Failure to provide this notice will result in the agreement renewing for a further 12 months.
All payments due during the 90-day notice period must be honoured in full.
7. Non-Payment and Suspension
Includability reserves the right to suspend services if payment is not received within 14 days of the due date.
Persistent failure to pay may result in contract termination and the outstanding balance becoming immediately payable.
8. Changes to Services or Pricing
Includability may revise service offerings or pricing with 30 days’ written notice.
If changes are not accepted, the Employer may cancel at the end of their term, subject to the notice period set out in Clause 6.2.
9. General Terms
This Agreement shall be governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
This Agreement constitutes the full understanding between the Parties and supersedes all prior discussions or representations.
Neither Party may assign or transfer this Agreement without the other Party’s written consent.
